Most companies and private entrepreneurs are already aware of the ban on the sale and use of plastic film bags and different types of plastic products on the territory of resort and recreational zone of the Issyk-Kul region. I consult multinational corporations in the food industry, manufacturers of soft and energy drinks and, therefore, thoroughly follow legislative changes in the industry.
The below information can be a useful heads-up for all manufacturers and distributors of food and beverages that use plastic bags, plastic package and plastic bottles because starting from 1 January 2027 the Law “On limiting the circulation of bags of polymer film and plastic products ” enters into force on the entire territory of Kyrgyzstan.
First, let’s take a look into the law itself. The law provides for a sanction that all income received from illegal activities related to the ban is subject to withdrawal and transfer to the republican budget. Moreover, the Code of the Kyrgyz Republic on Administrative Offenses provides for the following penalties:
1) Plastic production entails the imposition of a fine on individuals – 100 calculated indicators, for legal entities – 280 calculated indicators. I should note that as of today 1 calculated indicator equals to 100 soms.
2) Sale of plastic bags and plastic product: for individuals – 30 calculated indices, for legal entities – 130.
3) Violation of the ban on the free distribution of plastic film bags and plastic products in the trade and services sector entails a warning on individuals or legal entities. The same action repeated within a year after the issuance of the warning shall entail the imposition of a fine on individuals in the amount of 10 calculation indices, for legal entities 50 calculated indicators.
4) Violation of the ban on the use of plastic film bags and plastic products entails the imposition of a fine on individuals in the amount of 10 calculated indicators, for legal entities – 50 calculated indicators.
